1. Introduction

Welcome to Minstraly! By accessing or using our app, you agree to be bound by these Terms and Conditions.

Minstraly is a digital storytelling platform that allows users to create stories, generate audio using text-to-speech (TTS), and clone their voice for personalized narration.

2. Eligibility

Users must be 18 or older to create an account.
Children may use the app with the consent and supervision of a parent or legal guardian.

Adult Content (18+)

Erotic or other 18+ story genres are hidden by default and can only be accessed after you explicitly confirm that you are 18 years or older in your account settings.
Users under 18 must not enable or attempt to access 18+ content. Parents and guardians are responsible for monitoring minor access.
Minstraly is not liable for any harm or misuse that results from false age claims or unauthorized access to 18+ content.

3. User Content

You retain ownership of the stories and recordings you create.
By uploading content (including voice samples), you grant Minstraly a non-exclusive, royalty-free license to use, store, and process that content to provide and improve the service. This license ends when the content is deleted, except for required backups/logs.
You may not download, copy, scrape, record, rebroadcast, sell, or redistribute other users’ content without their explicit written permission. Personal viewing/listening only.
You are responsible for ensuring you have the right to use any content you upload.

4. Voice Cloning and Audio Processing

Consent: By accepting these Terms and Conditions, you explicitly consent to voice cloning and audio processing features.
Voice Samples: When you provide voice recordings, we may use them to create a voice clone for personalized story narration.
Processing: Your voice data may be processed by third-party AI services to generate voice clones and audio content.
Ownership: You retain ownership of your voice recordings, but grant us license to process them for service provision.
Children: For children under 13 (U.S.) or 16 (EU), parental consent is required before voice recording or cloning.
Revocation: You may revoke voice cloning consent at any time through your account settings.

5. Marketing Communications

Opt-in: Marketing emails are sent only with your explicit consent.
Content: Marketing communications may include product updates, tips, offers, and promotional content.
Unsubscribe: You can unsubscribe from marketing emails at any time through your account settings or by clicking unsubscribe links in emails.
Service Emails: Important service-related emails (account verification, password reset, etc.) will be sent regardless of marketing preferences.

6. Payments, Credits, and Subscriptions

Credits: Purchased credits are for in-app use only, have no cash value, and do not expire. If any credits from a purchase have been used, that purchase is non-refundable. Reward credits are non-withdrawable.
Purchase limits: Minimum credit purchase is $0.50; maximum is $10,000 per transaction. Bonus tiers may apply to larger purchases.
Credit rates & packages: Base rate is $1 = 10 credits. Fixed packages include $5→50, $10→105, $20→220, $50→575, $100→1200 credits. Custom amounts are allowed within the limits.
Feature costs (credits): Create story 6-15 (includes cover), voice clone 20, audio narration 12. Reward credits cannot be withdrawn.
Pricing and taxes: Prices are shown in USD unless otherwise indicated (local currency may be used if detected). Applicable taxes/VAT may be added at checkout. Receipts are emailed to your account address.
Auto-renew: Subscription plans auto-renew until canceled. Billing starts immediately. On cancellation, access continues through the paid period; no refunds for partial periods unless required by law. If proration or grace periods are offered, they will be shown in-app.
Chargebacks and disputes: We may suspend accounts for fraudulent or disputed payments and claw back related credits or payouts. Refunded or charged-back payments may create negative balances.
Extras: Extra voice clone purchases may be offered via one-time Stripe Checkout.
Creator/fan subscriptions: Creators can offer paid tiers (USD) with benefits like unlocking stories or direct messages. Checkout uses Stripe subscription mode, prevents self-subscription, and returns you to the creator profile on success/cancel. Platform fee defaults to 20% with Stripe Connect transfers.

7. Creator Earnings and Payouts

Creator earnings are subject to platform fees (default 20%), holding periods based on risk tier, and third party payment processing fees.
Tips revenue is converted to credits at $0.07/credit and held before payout; payout currency and schedule depend on third party payment availability; minimum payout thresholds may apply.
Payout availability may be delayed or reversed in cases of chargebacks, fraud, or policy violations. Negative balances may occur if refunds exceed available earnings.
Chargebacks or refunds on subscriber payments may reduce or reverse creator earnings.

8. Account Controls and Safety

You can set your account to private, gate direct messages to subscribers only, and toggle access to 18+ content.
You can grant or revoke voice cloning consent at any time.
Age-gating for 18+ content and parental consent for minors apply; bypassing age gates is prohibited.

9. Data Usage and Privacy

We collect and process your data as described in our Privacy Policy.
Your data may be used to improve our services, personalize your experience, and provide customer support.
We may use anonymized data for analytics and service improvement.
Third-party services may process your data for specific features (TTS, voice cloning, email delivery).

10. Prohibited Use

You agree not to use Minstraly to:

Upload offensive, harmful, or illegal content
Impersonate others or misrepresent voice ownership
Use cloned voices for malicious purposes or impersonation
Download, copy, record, scrape, or redistribute other users’ content without their explicit written permission
Violate intellectual property rights
Attempt to reverse engineer or hack the service
Use the service for commercial purposes without permission
Bypass age gates or access 18+ content without proper consent

11. Community Etiquette

Treat others with respect; no harassment, hate speech, or personal attacks.
Keep content and interactions appropriate to the selected audience settings (including 18+ gating).
Do not impersonate others, mislead about identity, or misuse voice clones.
Engage constructively in comments or messages; no spam, scams, or self-promotion without context.
Honor creator rights: do not copy, download, or redistribute works without explicit permission.
Report harmful or inappropriate content rather than retaliating.

12. Service Limitations

Voice cloning quality depends on the quality and length of voice samples provided.
We do not guarantee that voice clones will perfectly match the original voice.
Service availability may vary and is subject to technical limitations.
We reserve the right to limit or suspend service for any user at our discretion.
Fair use and rate limits may apply to protect service stability.

13. Account Termination

We reserve the right to suspend or delete accounts that violate our policies or misuse the platform. Upon account deletion, your data will be permanently removed from our systems.

14. Limitation of Liability

Minstraly is provided "as is" without warranties. We are not liable for any damages arising from use of the service, including but not limited to data loss, service interruptions, or issues with voice cloning quality.

15. Modifications

We may update these Terms at any time. Continued use after changes means you accept the new terms. Material changes will be communicated through the app or by email.
